Democrats Taking On Healthcare Insurers’ Antitrust Immunity

If Democrats get their way, healthcare insurers will lose their immunity from antitrust laws.  Democrats in the House and Senate are trying to strip the insurance industry of its decades-old exemption from federal antitrust laws, in the fight to overhaul the way healthcare is delivered in the United States.  If the legislation is passed, it will end the “price-fixing, bid-rigging and market allocation in the health and medical malpractice” insurance areas, according to Senator Patrick Leahy (D-VT), chairman of the Senate Judiciary Committee.  Leahy’s statement coincided with the House Judiciary Committee’s 20 – 9 vote to end the industry exemption.

Health insurers are fighting back, with Karen Ignagni, president and CEO of America’s Health Insurance Plans (AHIP) claiming that “We believe that health insurers have not been engaging in anti-competitive conduct and that McCarran – Ferguson does not provide a shield for such conduct” in a letter to Representative John Conyers (D-MI), who chairs the House Judiciary Committee.  The McCarran – Ferguson Act of 1945 gives states the ability to regulate the insurance industry for antitrust matters.  As a result, insurance companies currently are exempt from federal jurisdiction.

The moves to revoke healthcare insurers’ long-term immunity from antitrust laws reflect the Democrats’ anger in response to the industry’s attempts to shape reform legislation.  The action came shortly after AHIP issued a report asserting that a measure in the Senate Finance Committee would result in significantly higher premiums for people who current have healthcare insurance.  Democrats and President Obama attacked the study as flawed and motivated by politics.  According to the president, insurers are earning “profits and bonuses while enjoying a privileged exemption from our antitrust laws, a matter that Congress is rightfully reviewing.”

3912_healthcare-debateA political paradox in the healthcare debate lies in the fact that some members of Congress – whose constituents will benefit the most from reform legislation – oppose the bill. A study by the Urban Institute found there are 20 congressional districts where more than 30 percent of the residents lack even the most basic form of healthcare coverage.  California, Florida and Texas are home to 18 of those districts.

In three Florida districts where the uninsured comprise one-third of the population, the Republican representatives are solid in their opposition to healthcare reform.  Republican Representative Mario Diaz-Balart, whose south Florida district has 31 percent uninsured residents, bases his opposition on the belief that none of the Democrats’ proposals will cover all of his constituents.  “My constituents, they also understand that they are the ones that get stuck with the bills,” he said.

On the opposite side of the aisle, Texas Democratic Representative Henry Cuellar, whose district is in 10th place on the uninsured list, fears that cuts in Medicare will be used to pay for the expanded coverage.  Cuellar’s district includes a significant senior citizen population.

By contrast, Southern California’s districts with the most uninsured residents are Los Angeles and Orange County, home to many immigrants and low-income groups.  These areas are represented by Democrats who support healthcare reform, which would provide significant benefits to their constituents.

Modern Healthcare Names President Obama 2009’s Most Powerful Leader

obama-health-care-logoPresident Barack Obama’s historic effort to reform the nation’s broken healthcare system has placed him at the top of Modern Healthcare magazine’s “100 Most Powerful” leaders for 2009.

Despite the fact that the Democrats are losing some steam on healthcare reform and the Republicans are looking stronger for the 2010 midterm elections, Modern Healthcare magazine has saluted the importance of President Obama’s initiative and his willingness to risk his significant political capital on the most difficult issue in America.

According to Modern Healthcare, “As the debate rages on over reform, it’s clear that the top man In this year’s list, President Barack Obama, will face many more hurdles as he works to broker deals with sectors of the healthcare industry to achieve cost savings in his No. 1 domestic priority, while herding a still-divided Congress into approving a bill that he can sign his name to and claim as a victory for his administration.”

House Proposes $1.5 Trillion Healthcare Reform Package

The House of Representatives has proposed a $1.5 trillion package that would make healthcare coverage a right and a responsibility for all citizens.  If passed, medical providers, employers and the wealthy would pick up the tab.  The United States is the only developed nation that lacks healthcare coverage for all citizens, and approximately 50 Health Care Reformmillion people do not have access to insurance.

“We cannot allow this issue to be delayed.  We cannot put it off again,” says Representative Henry Waxman, a California Democrat and chairman of the House Energy and Commerce committee.  “We quite frankly cannot go home for a recess unless the House and the Senate both pass bills to reform and restructure our healthcare system.”

President Obama is promoting healthcare reform every chance he gets.  In a Michigan speech about spending for community colleges, he said, “There’s going to be a major debate over the next three weeks.  And don’t be fooled by folks trying to scare you saying we can’t change the healthcare system.  We have no choice but to change the healthcare system because right now it’s broken for many Americans.”

Organizing for America – Obama’s campaign organization – is launching a series of 30-second television ads on healthcare reform that will air in Washington D.C., on cable networks nationally and on local stations in eight states.  The ads depict ordinary citizens telling their stories about problems with the current healthcare system.

Democrats May Use “Nuclear Option” to Pass Healthcare Reform

The Obama administration is playing hardball to force Congress to pass healthcare reform legislation before the end of the year – preferably without the customary Republican-led filibuster delaying the final vote. obamahealthcare President Obama’s aggressive approach to protect healthcare legislation from Republican filibusters demonstrates the magnitude this ambitious reform package and has come to be called in some circles the nuclear option.

The agreement between the White House and Congressional Democrats lets healthcare legislation that meets budget targets win approval by a simple Senate majority — a process called reconciliation.  Not surprisingly, Republican leaders are up in arms about the no-filibuster deal, claiming that healthcare is too important to be exempt from the Senate’s usual rules.

Republicans have threatened to use their own procedural weapons to bog down the Senate if the Democrats try to restrict filibusters.  Options include forcing multiple votes on routine bills, inaction on administration nominations, or requiring lengthy legislation to be read in full.  Even some Democrats – notably Kent Conrad of North Dakota and Max Baucus of Montana – are uncomfortable with reconciliation.  Other Democrats point out that Senate Republicans successfully used reconciliation to enact President George W. Bush’s tax cuts in 2001 and 2003.

The president is relying on his significant political capital to push his agenda through, relying on unwavering support from his sizable Senate Democratic majority.  This is likely to total 60 Senators once the Minnesota courts finally certify Al Franken’s victory, and as a result of Arlen Specter’s surprise exit from the Republican Party. That could give President Obama the filibuster-proof majority he wants.
